Participation Conditions Testo Experts

The following conditions of participation govern access to and use of the content and functions on the website operated by Testo SE & Co. KGaA www.experts.testo.com (hereinafter referred to as "Testo Experts"). For the registered users of this offer (hereinafter also referred to as "panelists"), the following terms and conditions shall apply as amended from time to time. They apply to all one-time and ongoing services provided by Testo SE & Co. KGaA (hereinafter referred to as "Testo") in connection with the Testo Experts market research panel. In the event of changes in the law, changes in the services offered, etc., Testo reserves the right to adapt these terms of use for the future.

General information
The offer is addressed to Testo customers or users of Testo measuring instruments who register with Testo Experts via the website www.experts.testo.com. As part of the offer, Testo Experts panelists can participate in surveys conducted by Testo. These surveys are conducted on selected topics from Testo's business areas and serve to further develop products and services. By completing your registration, you agree to be bound by the following terms and conditions.

1. Eligibility for participation
Persons who have reached the age of 18 and live and work in Germany, the USA or Canada are eligible to participate.
Employees of the Testo group of companies are excluded from participation.

2. Use
The panelist registers at www.experts.testo.com and agrees and consents to participate in surveys conducted by Testo and to be contacted by Testo for these surveys.
Immediately after registration, the panelist is automatically sent a familiarization questionnaire. The panelist - once the registration and the initial questionnaire are completed - will be invited to participate in surveys from different subject areas. There is no right to participate in all surveys; invitations are based on the panelist's information and Testo's interests.
For each successfully completed survey, the panelist receives points. The panelist can convert these points into a donation to charity. Testo collects these points from all users and then triggers them as a donation from all users once a year to the appropriately named charities.
The contents of the surveys are to be treated confidentially. The panelist shall refrain from commercially exploiting the confidential content of the surveys in any way outside of this user relationship or from imitating them or having them exploited or imitated by third parties.

3. Access and due diligence
Prerequisite for the use of the offer is a successful registration by the panelist. For this, each panelist needs a valid email address and password. The user must provide a valid e-mail address when registering for the first time.
It is the panelist's responsibility to keep the password secret and to inform Testo immediately of any misuse of their access data that comes to their attention and to change their password immediately. Testo is not liable for damages resulting from misuse of the access data.
To protect the panelist, Testo will block access to the offer for 15 minutes in the event of multiple incorrect password entries or failed logins.
The information registered for the panelist can be changed or updated at any time in the personal area.
Each registered panelist may terminate their registration and use of Testo Experts at any time without notice. To terminate, the user must log in to Testo Experts and click on "Delete user account" under "Account". All accumulated points are irretrievably lost after deletion of the user account.

4. Availability
The user has no claim to access and availability of Testo Experts. It may be unavailable in particular due to maintenance work, interruptions, website failure or other disruptions, without the user being entitled to any claims against Testo as a result. Testo reserves the right to terminate or restrict the offer, parts thereof or individual usage options at any time or to exclude individual users from usage in justified exceptional cases.

5. Costs
There is no cost to the panelist for using Testo Experts.

6. Donation receipt
Each time you participate in a survey, you earn points as a thank-you for your commitment. Testo converts your points into a donation to your favorite charitable organization of our partners. Testo is not eligible to make out a tax-deductible donation receipt as it is not a charitable or non-profit organization.

7. Changes to these conditions
Testo reserves right to alter these conditions without notice at any time. Changes will be announced to the members in an appropriate manner - as a rule online. By participating in a survey for the first time since notification of the changes, the changes are deemed to have been accepted unconditionally by the participating person. Objection to the amendment of these terms and conditions shall be deemed termination of membership in Testo Experts.
Testo reserves the right, without any separate obligation to inform the panelists, to change, modify, delete and/or restrict or block access to Testo Experts and the website, in whole or in part, at any time for any reason or without stating any reason at all. In these cases, panelists are not entitled to any claims against Testo.
It is expressly emphasized that it is not possible to develop and design websites in such a way that they are error-free in every respect and at all times. Testo does not warrant the error-free and uninterrupted operation of Testo Experts and the corresponding website.
Testo does not guarantee 100% availability of Testo Experts. Furthermore, Testo can in no case be held liable for any inaccessibility of Testo Experts.

8. Data protection
Testo undertakes to comply with the data protection regulations of the Federal Republic of Germany, in particular those of the Federal Data Protection Act (BDSG), the Telemedia Act (TMG) and the Telecommunications Act (TKG). Personal data is collected, processed and used by Testo exclusively in accordance with the applicable data protection law.

Every panelist is free to revoke their participation in Testo Experts and thus the storage and use of their data.

9. Exclusion of liability
a) Testo accepts no liability for loss of data, in particular during data transmission, or other technical defects.
b) The forms sent in must not contain any offensive content, untruths or violations of competition, trademark or copyright law. The panelists themselves are responsible for any legal violations.
c) Testo is not liable for any damages due to malfunctions of technical systems, for delays or interruptions in transmissions or for damages associated with participation in the Testo Experts panel.

10. Other provisions
a) Testo reserves the right to exclude participants from participating in the Testo Experts panel on the grounds of false statements, misuse, damage to reputation, manipulation and/or use of unauthorized means, as well as breach of the conditions of participation.
b) The promoter’s decision is final.
c) The law of the Federal Republic of Germany is the exclusive applicable law.
d) Should any of these provisions be or become invalid, this shall not affect the validity of the remaining conditions of participation.
e) These conditions of participation may be amended by Testo at any time without additional notification.
